Section 1 — Introduction & Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the website located at belleandrue.com (including all associated web pages and social media pages) (the "Site"), the services provided by Belle & Rue LLC ("Company," "we," "our," or "us"), and your purchase of any makeup, beauty, or cosmetic products from us ("Products").
By placing an order, accessing, browsing, or otherwise using the Site, or by clicking "Accept," "Purchase," or a similar confirmation button, you confirm that you have read, understood, and agreed to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SITE OR PURCHASE ANY PRODUCTS.
IMPORTANT: THESE TERMS CONSTITUTE A LEGALLY BINDING CONTRACT BETWEEN YOU AND THE COMPANY. THEY INCLUDE A MANDATORY INDIVIDUAL ARBITRATION PROVISION AND CLASS ACTION WAIVER AS SET FORTH IN SECTION 24. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
We may update these Terms at any time. The "Last Updated" date at the top of this document reflects when changes were last made. Your continued use of the Site following any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Section 2 — Eligibility
By using our Site, you represent and warrant that:
• You are at least 18 years of age, or the age of legal majority in your jurisdiction;
• You have full legal capacity to enter into and be bound by these Terms;
• You are using the Site for personal, non-commercial purposes only — to browse and purchase Belle & Rue products for yourself or as a gift, and not for resale or any unlawful purpose;
• All registration and order information you provide is accurate, current, and complete;
• You will comply with all applicable local, national, and international laws in connection with your use of the Site.
We reserve the right to refuse service, cancel orders, or suspend access to any person at any time and for any reason, at our sole discretion.
Section 3 — Accounts
We may offer you the ability to create a free account on the Site ("Account"). If you create an Account, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to notify us immediately at support@belleandrue.com if you suspect any unauthorized access to your Account.
You may not create an Account using a false identity, impersonate any other person, or register on behalf of a third party without their express written authorization. We reserve the right to suspend, deactivate, or permanently terminate any Account at our sole discretion, including where we suspect a violation of these Terms, fraudulent activity, or any misuse of the Site. If your Account is terminated, you may not re-register without our prior written consent.
Section 4 — Promotions & Campaign Offers
From time to time, we may offer promotional discounts, flash sales, limited-time offers, or campaign pricing on our Site ("Promotions"). The following conditions apply to all Promotions:
• Promotions are valid only for the period and under the conditions stated in the relevant promotional communication, and only while stock lasts.
• All Promotions are subject to product availability. We reserve the right to amend, pause, or withdraw any Promotion at any time where required due to circumstances beyond our control, including but not limited to stock shortages, technical errors, pricing errors, or suspected misuse.
• Any such changes will not affect orders that have already been confirmed by email at the time the change takes effect.
• Promotions may not be combined with other offers, discount codes, or promotions unless explicitly stated otherwise.
• In the event of an obvious pricing or technical error, we reserve the right to cancel or decline orders placed under such error, in accordance with applicable consumer protection law.
Participation in any promotion or contest may be subject to additional terms, which will be made available at the time of the relevant promotion.
Section 5 — Product Information & Descriptions
We make every effort to ensure that product descriptions, images, pricing, availability, and other information on the Site are accurate and up to date. However, we cannot guarantee that all such information is always error-free, complete, or current. Please be aware of the following:
• Product images are provided for illustrative purposes only. While we strive to display colors and finishes as accurately as possible, the appearance of colors on your screen will vary depending on your device's display settings and capabilities. We cannot guarantee that on-screen shades precisely match the actual product.
• Product packaging may differ from what is shown in images on the Site, particularly where packaging is updated or refreshed.
• Product descriptions are provided in good faith as guidance only. Actual products may vary slightly from their descriptions.
• Pricing displayed on the Site is subject to change without prior notice.
We reserve the right to correct any errors in product information at any time and to cancel orders placed based on inaccurate pricing or product details. If your payment has already been processed for a cancelled order, a full refund will be issued to your original payment method.
Section 6 — Cosmetic Product Safety & Disclaimers
All Belle & Rue makeup and cosmetic products are formulated with care and in accordance with applicable cosmetic safety regulations. However, individual reactions to cosmetic ingredients can vary. By purchasing and using our Products, you acknowledge the following:
Patch Testing
We strongly recommend performing a patch test before applying any new product, particularly if you have sensitive skin, known allergies, or a history of skin reactions. To patch test, apply a small amount of product to the inner wrist or behind the ear, wait 24 hours, and check for any adverse reaction before broader use.
Ingredient Transparency
A full ingredient list is provided on each product page and on product packaging. You are responsible for reviewing ingredient information prior to purchase and use. If you have known sensitivities or allergies to any cosmetic ingredients, please review product ingredient lists carefully before ordering.
Intended Use
Our products are intended for external cosmetic use only on the areas specified in the product description, unless otherwise stated. They are not intended to diagnose, treat, cure, or prevent any medical condition. Keep all products out of reach of children.
Discontinuation of Use
If you experience any irritation, redness, swelling, burning, or discomfort during or after use, discontinue use immediately and consult a qualified healthcare or dermatology professional.
Belle & Rue LLC is not responsible for adverse reactions resulting from misuse, failure to perform a patch test, failure to review ingredient information prior to use, or use of the product on skin that is broken, inflamed, or otherwise compromised.
Section 7 — Terms of Sale
Eligibility to Purchase
To complete a purchase, you must provide a valid billing and shipping address within a country supported at checkout. We make no representation that all Products are lawful or available for use in all locations.
Pricing & Taxes
Prices displayed on the Site are in the applicable currency and exclude taxes, import duties, and shipping fees, all of which will be calculated and clearly shown before you confirm your order. You will have the opportunity to review your full order total, including all applicable charges, before completing payment. Prices are subject to change without notice.
Payment
By placing an order, you confirm that you are authorized to use the payment method provided. You authorize us to charge the full order amount, including taxes and shipping fees, to your chosen payment method. We accept major credit and debit cards and any additional payment methods listed at checkout.
Order Confirmation
Your order is accepted and a binding purchase agreement is formed when we send you an order confirmation email containing an order reference number. We reserve the right to decline or cancel any order prior to dispatch — for example, if a product becomes unavailable, a pricing error is identified, or we are unable to verify payment. In such cases, a full refund will be issued promptly.
Payment Disputes & Inaccuracies
You are obligated to report any inaccuracies in your payment or billing information to us immediately. If a payment is not successfully processed, we may suspend fulfillment of the order until payment is confirmed.
Section 8 — Order Limits & Restrictions
To ensure fair access to our products for all customers, we reserve the right to limit quantities per order, per account, per payment method, or per household. Orders that appear to be placed for commercial resale or that otherwise violate these Terms may be cancelled without prior notice.
Products and any complimentary samples we may include are intended for personal use only. You may not resell, redistribute, or commercially exploit any products purchased from or received through the Site.
We reserve the right, at our sole discretion and without prior notice, to refuse, reduce, or cancel any order we reasonably believe violates these Terms, represents an attempt to circumvent our ordering policies, or is otherwise fraudulent.
Section 9 — Shipping & Delivery
We will make commercially reasonable efforts to dispatch your order promptly following confirmation. Estimated delivery timeframes are provided in good faith but are not guaranteed and may be affected by carrier performance, customs clearance (for international orders), or other factors outside our control.
Title and risk of loss transfer to you upon our delivery of your order to the carrier. We are not liable for delays, loss, or damage occurring after handover to the carrier.
If your order cannot be fulfilled within 30 days of the order date, we will notify you. In such cases, you have the right to cancel your order and receive a full refund without any penalty.
Shipping charges will be displayed and confirmed at checkout before payment is taken. We are not responsible for any delays attributable to customs inspection, import processing, or events beyond our reasonable control.
Section 10 — International Orders
Belle & Rue LLC ships to international destinations. By placing an international order, you acknowledge and agree to the following:
• You are the Importer of Record for your shipment and are responsible for all applicable import duties, customs fees, taxes, and brokerage charges levied by your country's authorities. These charges are not included in our prices and are not within our control.
• You agree to comply with all laws and regulations of your destination country governing the import and use of cosmetic products. Our products are formulated to meet applicable U.S. standards, and we make no representation that they satisfy the regulatory requirements of any other jurisdiction.
• International shipments may be subject to customs inspection and delay. We have no control over customs processing timelines and accept no liability for resulting delays.
• If you refuse delivery of an international shipment for any reason, you remain responsible for the original outbound shipping charges and any costs associated with the return of the shipment, which may be deducted from any applicable refund.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Uniform Computer Information Transactions Act (UCITA) do not apply to these Terms or to any transactions conducted on our Site.
Section 11 — Returns, Refunds & Right of Withdrawal
We want every Belle & Rue customer to be completely satisfied. If you are unhappy with your purchase, you may return eligible Products within 14 days of receiving your order, subject to the following conditions:
• You must notify us of your intention to return within the 14-day window by contacting us at support@belleandrue.com with your order number and reason for return.
• Eligible products must be returned in their original, unused, and undamaged condition, in original packaging where possible.
• Return shipping costs are the responsibility of the customer, unless the return is due to a defective, damaged, or incorrectly dispatched product.
• Refunds will be processed to the original payment method within 14 days of our receipt and inspection of the returned item, provided the return meets the conditions above.
• Original shipping charges are non-refundable unless the return is due to our error.
We reserve the right to decline returns that do not comply with these conditions, including products that show signs of use, damage caused by the customer, or returns initiated outside the 14-day window.
Damaged or Incorrectly Dispatched Products
If your order arrives damaged, defective, or does not match what you ordered, please contact us at support@belleandrue.com within 48 hours of delivery with a clear photograph of the issue. We will arrange a replacement or issue a full refund at no additional cost to you.
Section 12 — Non-Returnable Products
For reasons of hygiene and consumer health protection, certain products are not eligible for return once their original sealed packaging has been opened or the hygiene seal has been broken. This applies in particular to:
• Lip products (lipsticks, lip glosses, lip liners);
• Eye products (mascaras, eyeliners, eyeshadow palettes);
• Foundation, concealer, and complexion products where the original seal has been broken;
• Any product that by its nature cannot be resold once unsealed due to hygiene considerations.
This exclusion applies only where we have clearly communicated it to you prior to purchase. Where a product is sealed at the time of return and has not been used, our standard 14-day return policy applies.
Nothing in this section affects your statutory rights in relation to defective or misdescribed goods.
Section 13 — Complaints Procedure
We take all customer concerns seriously. If you are dissatisfied with any aspect of your order or our service, please follow the process below:
• Submit your complaint in writing by emailing support@belleandrue.com with a full and clear description of the issue, your order number, and any relevant supporting information (e.g., photographs).
• We will acknowledge receipt of your complaint within 14 days of receiving it.
• Where a complaint requires more detailed investigation, we will provide you with an acknowledgment of receipt and an estimated timeline for our full response within that 14-day period.
• We will make every effort to resolve your complaint promptly and fairly.
If you remain unsatisfied following our response, you may seek further recourse through applicable consumer protection channels in your jurisdiction.
Section 14 — User Contributions & Reviews
Our Site may allow you to submit product reviews, ratings, comments, or other content ("Contributions"). By submitting a Contribution, you represent and warrant that:
• You are the creator and owner of, or have all necessary rights to, the content you submit;
• Your Contributions are truthful, reflect your genuine firsthand experience, and are not misleading;
• Your Contributions do not infringe any third-party intellectual property, privacy, or other rights;
• Your Contributions do not contain unlawful, defamatory, obscene, harassing, abusive, or fraudulent content;
• Your Contributions do not contain any unsolicited commercial communications, spam, or promotional material.
By submitting a Contribution, you grant Belle & Rue LLC a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, publish, distribute, and display such Contributions across any medium for any legitimate business purpose, without compensation to you.
We reserve the right to remove, moderate, or decline to publish any Contribution at our sole discretion and without notice.
Section 15 — Prohibited Conduct
By using our Site, you agree that you will not:
• Use the Site for any unlawful, fraudulent, or unauthorized purpose;
• Attempt to gain unauthorized access to any part of the Site, other user accounts, or our systems;
• Copy, scrape, reproduce, or redistribute any content from the Site without our prior written consent;
• Upload or transmit viruses, malware, or any other harmful or disruptive code or content;
• Interfere with or disrupt the performance or security of the Site;
• Reverse engineer, decompile, or attempt to derive the source code of any part of the Site;
• Resell, commercially exploit, or otherwise misuse any Products purchased from the Site;
• Post or transmit spam, unsolicited messages, or unauthorized promotional content;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Engage in any conduct that restricts or inhibits any other user's enjoyment of the Site.
We may suspend or permanently terminate your access to the Site at our sole discretion and without notice if we determine that you have violated these Terms or applicable law.
Section 16 — Intellectual Property & Ownership
All content on the Site, including but not limited to logos, brand name, text, graphics, photographs, product imagery, videos, and software (collectively, "Content"), is owned by or licensed to Belle & Rue LLC and is protected under applicable intellectual property laws.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for personal, non-commercial purposes. You may not copy, reproduce, republish, upload, transmit, distribute, or create derivative works from any Content without our prior written permission.
Section 17 — Third-Party Services & Links
The Site may contain links to third-party websites and may integrate third-party payment processors (such as PayPal, Stripe, or similar services). We do not control, endorse, or accept responsibility for the content, products, services, or practices of any third-party websites or processors. Your interactions with any third party are governed solely by that party's own terms and conditions and privacy policy, and we encourage you to review those documents before use.
Section 18 — Copyright Policy
If you believe that any content on the Site reproduces or infringes your copyright, please send a written notice to our designated copyright agent that includes the following:
• Your physical or electronic signature;
• A description of the copyrighted work you believe has been infringed;
• The specific URL or location on the Site where the allegedly infringing material appears;
• Your contact information, including your name, address, telephone number, and email address;
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on their behalf.

We collect, use, and protect your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference and available on our Site at www.belleandrue.com. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy.
Section 20 — Feedback
Any suggestions, ideas, or feedback you voluntarily submit to us regarding our Products or Site ("Feedback") may be used by us for any purpose, including improving existing products or developing new offerings, without compensation or credit to you. By submitting Feedback, you grant us a perpetual, royalty-free, worldwide license to use such Feedback in any manner.
Section 21 — Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SITE AND PURCHASE OF PRODUCTS IS AT YOUR SOLE RISK.
Section 22 — Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BELLE & RUE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS, YOUR USE OF THE SITE, OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM OR $50.00 USD.
Some jurisdictions do not permit the exclusion or limitation of certain damages; the above limitations may not apply to you to the extent prohibited by applicable law.
Section 23 — Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Belle & Rue LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Products; (b) any Contributions you submit; (c) your breach of these Terms; or (d) your violation of any applicable law or any third-party right.
Section 24 — Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution First
Before initiating any formal legal proceeding, you agree to first contact us at support@belleandrue.com with a written description of your dispute and the resolution you are seeking. We will attempt to resolve any dispute informally within 60 days of receiving your notice.
Binding Individual Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising from or relating to these Terms or the Site shall be resolved by final and binding individual arbitration, not in court. Arbitration will be conducted by a recognized arbitration body under its applicable rules, as modified by these Terms. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Class Action Waiver
YOU AND BELLE & RUE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Small Claims Exception
Either party may bring a claim in a small claims court of competent jurisdiction for disputes falling within that court’s limits. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.
Time Limitation on Claims
Any claim arising from or related to these Terms must be brought within one (1) year of the date the cause of action arose. Claims not brought within this period are permanently barred.
Section 25 — Governing Law & Venue
These Terms and any dispute arising from or related to them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Wyoming, and you irrevocably consent to the personal jurisdiction of those courts.
Section 26 — General Provisions
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be severed and the remaining provisions shall continue in full force and effect.
These Terms constitute the entire agreement between you and Belle & Rue LLC with respect to your use of the Site and supersede all prior or contemporaneous written or oral agreements relating to the same subject matter. We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. No waiver shall be effective unless made in writing.
Any provisions intended by their nature to survive termination of these Terms (including, without limitation, intellectual property, indemnification, limitation of liability, and dispute resolution provisions) shall survive any termination or expiration.
